How to terminate a lease agreement (without paying for the whole term)

A fixed-term lease does not end because you move out. Ending it early means using a break clause, a statutory right, an agreed buy-out โ€” or relying on the landlord's duty to re-rent.

A lease agreement is a contract giving a tenant the right to occupy a property for a set period in exchange for rent. A month-to-month tenancy ends by giving the notice the lease or state law requires โ€” commonly 30 days. A fixed-term lease does not end early simply because the tenant leaves: rent remains due for the term unless a break clause, a statutory right, a negotiated exit, or the landlord's duty to mitigate reduces it.

Five ways out of a fixed-term lease

1. A break clause in the lease. Some leases include an early-termination option: notice plus a fee, often one or two months' rent. Read the exact conditions โ€” a missed notice window makes the clause useless.

2. A statutory right. Many states allow early termination without penalty in defined situations: active-duty military relocation under the federal Servicemembers Civil Relief Act, domestic-violence protections, a landlord's failure to maintain habitability, or an uninhabitable unit. These are state-specific and generally require documentation and written notice.

3. Negotiated exit. The most common outcome in practice. Offer something concrete: an early-termination payment, an extended notice period, help showing the unit, or a qualified replacement tenant. Get the agreement in writing, and make sure it says the tenancy is terminated on a stated date and the deposit will be handled per the lease โ€” otherwise you may be argued back onto the hook.

4. Assignment or sublet. Many leases permit it with landlord consent. Note the difference: under a sublet the original tenant usually remains liable; under an assignment the new tenant takes over the lease. Never do either without written consent if the lease requires it.

5. Duty to mitigate. In many states a landlord must make reasonable efforts to re-rent after a tenant leaves, rather than let the unit sit empty and bill the departing tenant for the full remaining term. Where the duty applies, the tenant owes rent for the vacancy period plus reasonable re-letting costs โ€” not automatically the balance of the lease. The rule varies by state, so check it before assuming either way.

What does not end a lease

  • Moving out and returning the keys. Surrendering possession does not by itself end the obligation to pay.
  • Stopping payment. That is a default, and produces an eviction record and a collections claim.
  • A verbal agreement with the landlord. Common, and impossible to prove when the deposit is withheld. Email counts as writing; a hallway conversation does not.

For landlords ending a tenancy

Terminating a month-to-month tenancy takes the statutory notice period, in writing, served the way state law prescribes. Ending a fixed-term lease early requires a ground under the lease or state law โ€” and removing a tenant, in either case, means the court eviction process. Self-help โ€” changing locks, removing belongings, shutting off utilities โ€” is unlawful in every state and exposes the landlord to damages well beyond the rent at stake.

Protect the deposit on the way out

Give written notice in the form the lease requires, keep proof of delivery, document the unit's condition with dated photographs, attend the walk-through if one is offered, and give a forwarding address in writing. Most states set a deadline for returning the deposit with an itemized statement of deductions โ€” the forwarding address is often what starts that clock.
