Demand Letter
A formal demand for payment sent before filing suit. The letter sets out the agreement or event the claim arises from, the amount owed and how it is calculated, any interest claimed, the payment deadline, and what happens if the deadline passes. Courts and judges expect to see one: a documented demand shows the defendant had a chance to pay, and in several states a pre-suit demand is a statutory prerequisite to consumer-protection damages (Massachusetts Gen.
