Notice to vacate vs eviction notice: which one do you need?
A notice to vacate ends a tenancy that nobody has breached. An eviction notice responds to a default. Serving the wrong one wastes the notice period and hands the tenant a defence.

A notice to vacate ends a tenancy where nobody has done anything wrong โ most often a month-to-month tenancy, terminated on 30 or 60 days' notice. An eviction notice responds to a default: unpaid rent, a lease violation, or serious misconduct, and gives a much shorter period. Both can be served by a landlord; only the notice to vacate is also something a tenant commonly serves, to end their own tenancy.

When a no-cause notice is not actually available
This is the trap in the modern rules. A growing number of states and cities require just cause even to end a month-to-month tenancy: the landlord must state an allowed reason โ such as moving in, selling, or substantial renovation โ and in some places pay relocation assistance. Others require 60 days rather than 30 once the tenant has lived there a year or more.
So before drafting a plain 30-day notice, check three things about the property's location: whether no-cause termination is permitted at all, what the period is for that tenancy length, and whether relocation assistance applies. Getting this wrong is expensive precisely because it looks so simple.
What each document should say
Notice to vacate (landlord to tenant): tenant names and property address, a clear statement that the tenancy terminates, the termination date, the notice period being given, that rent remains payable to that date, instructions for keys and a forwarding address, and how the security deposit will be handled.
Notice to vacate (tenant to landlord): your name and the address, the date you will hand back possession, a request for a walk-through inspection, your forwarding address for the deposit, and the date and your signature. Serve it in the manner your lease requires โ many leases specify written notice delivered a set number of days before the next rent date.
Eviction notice: the ground with facts, what the tenant must do (pay a stated sum or take a specific step), the deadline, and the consequences.
The step both types share: proof
The notice period runs from service, not from the date typed on the page. Keep evidence: personal delivery witnessed, certified mail receipts, or posting plus mailing where the state permits it, all recorded in a proof-of-service block. A landlord who cannot prove when service happened cannot prove the period expired.
And the step neither type skips
Neither document removes anyone. If a tenant remains after a valid notice to vacate expires, they are holding over โ and the remedy is still an eviction action and a court order, enforced by a sheriff or marshal. Self-help lockouts, removed belongings and shut-off utilities are unlawful in every state, whichever notice was served.
Deposits, on the way out
Most states set a deadline for returning the security deposit with an itemised statement of deductions, often triggered by the tenant providing a forwarding address. Both notices should therefore ask for one. Document the unit's condition with dated photographs at move-out โ that record decides deposit disputes far more often than the lease language does.
