Contract of Employment
A contract of employment for the Republic of Ireland that contains the particulars section 3 of the Terms of Employment (Information) Act 1994 requires, so a separate written statement is not needed, and then goes considerably further. It sets the minimum notice ladder in section 4(2) of the Minimum Notice and Terms of Employment Act 1973 and explains why a shorter contractual period does not bind; annual leave under the three alternative measures in section 19 of the Organisation of Working Time Act 1997, taking the greater; the ten public holidays, including the February holiday prescribed by S.I. No. 50 of 2022 and the rule that moves it to 1 February when that day is a Friday; rest breaks, the 48-hour average and Sunday compensation; deductions drafted to satisfy every condition in section 5 of the Payment of Wages Act 1991; and a confidentiality clause carved back for protected disclosures and for the discrimination and harassment disclosures that section 14B of the Employment Equality Act 1998 has protected since 20 November 2024.
