Vehicle Bill of Sale

A bill of sale for the private sale of a car, van or motorcycle in the Republic of Ireland. It records the parties, the vehicle by registration, VIN, mileage and condition, the price and how it is paid, and the moment property passes. It is also honest about the two things most Irish bill-of-sale templates get wrong. First, this document does not change the registered owner: on a vehicle first licensed in the State on or after 1 January 1993, article 10(8) of S.I. No. 385 of 1992 requires the buyer to complete Part B of the vehicle registration certificate and the seller to send it to the Department of Transport, and until that is done the seller stays on the National Vehicle and Driver File for tolls, fines and motor tax. Second, "sold as seen" does not do what people think. Section 55(3) of the Sale of Goods Act 1893 makes it impossible to exclude the seller's implied condition that they have a right to sell — so outstanding finance is never covered — and section 13(9) of the Sale of Goods and Supply of Services Act 1980 makes it impossible to exclude the implied condition that the vehicle is free from any defect rendering it a danger to the public. That one can only be displaced by the signed statement in section 13(3), which this wizard will draft where the vehicle is genuinely being sold for parts or repair.
