Last Will and Testament
A will for a person domiciled in the Republic of Ireland, drafted against the Succession Act 1965. It is executed in the form section 78 requires: signed at the foot or end by the testator, whose signature is made or acknowledged in the presence of two witnesses present at the same time, each of whom attests in the testator's presence. It appoints executors and, where there are young children, guardians and a trust. And it does the thing free Irish will templates do not: it works out the legal right share. Section 111 gives a surviving spouse one half of the estate where there are no children and one third where there are, section 111A gives a civil partner the same, and section 112 makes that share take priority over every gift in the will. A will that leaves a spouse out does not disinherit them; it just describes an outcome that will not happen. This wizard blocks that, offers the two lawful routes — a renunciation under section 113 or a court order on judicial separation — and handles the trap in section 114(2), under which a gift to a spouse is treated as satisfying the legal right share unless the will says it is in addition to it.
