Room Licence Agreement (Rent a Room)
A licence agreement for an owner-occupier in Ireland who lets a room in the home they live in. Because section 3(2)(g) of the Residential Tenancies Act 2004 excludes a dwelling within which the landlord also resides, this arrangement is a licence and not a tenancy: no Part 4 security of tenure arises after six months, the tenancy cannot be registered with the RTB, neither party may refer a dispute to the Board, and the statutory notice periods in section 66 do not apply. The agreement sets the licence fee, the room and shared areas, house rules, the agreed notice period, and records the Revenue rent-a-room relief position — income of up to €14,000 a year from letting a room in your own home is exempt from income tax, but exceeding that limit by a single euro makes the whole amount taxable.
