Tenancy Deposit Dispute Letter
A letter from a tenant to a landlord or agent about a tenancy deposit in England or Wales. It disputes the deductions claimed, requires the landlord to evidence each one — deductions must reflect actual loss, fair wear and tear is not deductible and betterment is not chargeable — and refers the dispute to the free alternative dispute resolution service run by the deposit scheme. Where the answers show the deposit was not protected in an authorised scheme, or the prescribed information was not given within 30 days of receipt, the letter also raises the claim under sections 213 to 214 of the Housing Act 2004, under which the county court can order the landlord to repay the deposit and pay the tenant between one and three times its amount.
